La agencia de viajes digital A VIAJAR SE HA DICHO (en adelante, LA AGENCIA) es de titularidad de LETSCLOUD S.A.C., identificado con número de RUC N° 20606067641, cuyos datos de contacto son: 

  • Domicilio fiscal: Calle Los Negocios No. 179, Interior 1304, distrito de Surquillo, provincia y departamento de Lima. 

Los términos y condiciones contenidos en este instrumento se aplicarán y se entenderán que forman parte de todos los actos y contratos que se ejecuten o celebren con LA AGENCIA entre los Usuarios de este sitio, así como, entre ellos y LETSCLOUD S.A.C. 

PRECIOS 

Todos los precios son en soles (PEN) y están sujetos a cambio sin previo aviso. Los precios son por persona, como mínimo dos personas, a menos que se especifique lo contrario. 

 

CAMBIOS Y MODIFICACIONES EN ITINERARIO 

Los itinerarios se planean con gran cuidado, aunque por razones operacionales, puede ser necesario cambiar la secuencia de actividades en el itinerario o la ruta especificada, y aunque estos casos son excepcionales, en general el itinerario debe ser tratado sólo como una pauta. 

 

NO INCLUIDO 

El pasajero es responsable de la obtención de pasaportes, visas, seguro de viaje, pago de exceso de equipaje, las peticiones personales tales como bebidas extras, servicio de lavandería, comunicación (llamadas, correos electrónicos, etc.), impuestos de salida del aeropuerto nacional e internacional, propinas, u otros servicios y gastos no especificados en el itinerario 

 

SERVICIOS NO UTILIZADOS 

Algunos servicios pueden ser interrumpidos o cancelados debido a las condiciones climáticas, razones de fuerza mayor, actos de la naturaleza, huelgas, etc., u otras personas ajenas a los hoteles, líneas aéreas y otros proveedores, LA AGENCIA o sus asociados. No se hará ningún reembolso como resultado de estas interrupciones o cancelaciones que se escapan a nuestro control. 

 

SEGURO 

Recomendamos tener un seguro de salud o de viaje actualizado y los contactos a la mano en caso sea necesario. De igual manera, comunicar cualquier condición médica que pueda afectarlo durante el viaje. 

 

PASAJES DE AVIÓN 

Los precios de boletos aéreos están sujetos a cambios sin previo aviso hasta su emisión final. Los horarios de vuelos están sujetos a cambios por las compañías aéreas hasta el día del vuelo. Restricciones adicionales, limitaciones, multas y/o condiciones específicas pueden ser colocadas por las líneas aéreas.

Para realizar una reserva, la siguiente información se requiere, para cada viajero: 

  • Apellidos y nombres completos 

  • Número y tipo de documento de identidad (DNI o Carnet de extranjería)

Debido a la realidad actual toda reserva debe ser confirmada por LA AGENCIA y están sujetas a la apertura de carreteras, ciudades y sitios de visita.

PASAJES DE AVIÓN 

Los precios de boletos aéreos están sujetos a cambios sin previo aviso hasta su emisión final. Los horarios de vuelos están sujetos a cambios por las compañías aéreas hasta el día del vuelo. Restricciones adicionales, limitaciones, multas y/o condiciones específicas pueden ser colocadas por las líneas aéreas. 

Debe pagar el 100% para emitir pasajes de avión. Las tarifas están sujetas a disponibilidad en el momento de la compra y el precio base (devoluciones y cambios permitidos/no permitidos, aplica/no aplica sanciones, etc.). Los pasajes son no reembolsables ni endosables en caso de cancelación. 

 

CONDICIONES DE RESERVA  

Para realizar una reserva, la siguiente información se requiere, para cada viajero: 

  • Apellidos y nombres completos 

  • Número y tipo de documento de identidad (DNI o Carnet de extranjería)

FORMAS DE PAGO 

a. Transferencias Bancarias: 

Los pagos deben hacerse a la siguiente cuenta corriente en: 

INTERBANK: Cuenta Corriente Soles nombre de LetsCloud SAC.

Todos los gastos de transferencia interbancaria deben ser pagados por el viajero. 

Para poder validar el pago realizado, enviar por correo electrónico el voucher de depósito o comprobante de transferencia. 

  

b. Pagos con tarjeta de crédito: 

Pago con tarjeta de crédito está disponible. Se enviará un enlace de pago, que autoriza a LA AGENCIA a cargar el monto por los servicios solicitados a su tarjeta de crédito o débito Visa, Master Card o American Express, a su debido tiempo. 

 

CANCELACIONES Y REEMBOLSOS 

Las notificaciones de cancelaciones y solicitudes de reembolso deben hacerse por escrito a la cuenta de correo electrónico: hola@aviajarsehadicho.com incluyendo todos los datos pertinentes, para recibir atención inmediata por LA AGENCIA. 

Las políticas de cancelación se encuentran detallados en cada servicio dentro de la página web. 

 

REEMBOLSOS EN CASO DE CANCELACIÓN  

Aplican cargos de cancelación diferentes para los diferentes hoteles y proveedores de servicios. LA AGENCIA no escatimará esfuerzos para mantener estos cargos tan bajos como sea posible.   

Penalidades por cancelación pueden variar de acuerdo al programa y/o producto. 

Pueden aplicarse condiciones más restrictivas de prepago y cargos por cancelación a algunas fechas, hoteles y proveedores de servicios. Estas condiciones se mencionan específicamente por nuestro asesor de viajes en el momento de su solicitud. 

 

FECHAS ESPECIALES 

Algunos servicios de aumentan sus tasas durante algunos días festivos o fechas especiales: 

  • Semana Santa (jueves, viernes, sábado y domingo de la 1ra semana de abril, las fechas varían cada año) 

  • 1 de mayo (celebración del día del trabajo en el Perú) 

  • Inti Raymi 

  • Fiestas Nacionales (29 de junio, 28 y 29 de julio, 30 de agosto, 8 de octubre, 1ero de Noviembre, 8 de diciembre) 

  • Navidad (24 y 25 de diciembre) 

  • Año Nuevo (31 de diciembre y 1 de enero) 

  • Eventos específicos y fines de semana largo

POLÍTICAS DE LOS NIÑOS 

Las políticas de niños deben ser consultadas con LA AGENCIA debido a que varían de acuerdo a cada servicio.

These Terms and Conditions apply to the use of this website, as well as to all quotations, reservations, purchases, services, communications, acts and contracts entered into between users, clients or travellers and ANDINA REISEN S.A.C.

 

By accessing this website, requesting a quotation, confirming a reservation, making a payment or purchasing any travel service through THE AGENCY, the user declares that they have read, understood and accepted these Terms and Conditions.

1. About Andina Reisen

Andina Reisen is a digital travel agency and travel designer. In this role, THE AGENCY assists travellers in understanding their interests, preferences and budgets; helps clients discover unique and carefully selected experiences; suggests personalized itineraries; and supports the planning and coordination of travel arrangements through curated packages and professional destination expertise.

THE AGENCY may act as an organizer, coordinator, intermediary or commercial representative for travel-related services provided directly by third-party suppliers, including but not limited to hotels, transport companies, tour operators, guides, restaurants, airlines, travel assistance providers and local experience providers.

2. Scope of Services

The services offered by THE AGENCY may include, among others:

  • Design of personalized travel itineraries.

  • Hotel and accommodation reservations.

  • Transfers and private or shared transportation.

  • Tours, excursions and travel experiences.

  • Coordination with local suppliers and destination specialists.

  • Assistance before and during the trip.

  • Issuance of quotations, confirmations and travel documentation.

  • Other tourism-related services agreed with the client.

The exact services included in each booking will be detailed in the corresponding quotation, itinerary, confirmation email or commercial proposal.

Any service not expressly included in the quotation or confirmation shall be considered excluded.

3. Quotations and Prices

All quotations issued by THE AGENCY are based on availability, supplier conditions and prices valid at the time of issuance.

Unless expressly stated otherwise, quotations do not guarantee availability or final price until the reservation has been confirmed and the corresponding payment has been received.

Prices may vary due to changes in availability, exchange rates, taxes, supplier rates, seasonal supplements, entrance fees, transportation costs or other factors beyond the control of THE AGENCY.

THE AGENCY will inform the client of any relevant change before confirming the reservation whenever possible.

4. Reservation Confirmation

A reservation shall be considered confirmed only when:

  • The client has accepted the quotation or travel proposal.

  • The required payment or deposit has been received.

  • THE AGENCY has issued a written confirmation by email, message or other official communication channel.

Until these conditions are met, services remain subject to availability.

The client is responsible for carefully reviewing the confirmation documents, including names, dates, services, destinations, schedules and other travel details. Any error must be reported immediately to THE AGENCY.

5. Payments

Payment conditions, deadlines, accepted methods and currency will be indicated in the quotation, invoice, payment link or confirmation document.

Failure to make payments within the established deadlines may result in the automatic cancellation of the reservation, loss of availability, application of penalties or modification of the quoted price.

Bank fees, payment processor fees, exchange rate differences, international transfer costs or other financial charges shall be borne by the client, unless expressly agreed otherwise.

THE AGENCY may request partial or full payment depending on the nature of the service, supplier requirements, travel dates or cancellation conditions.

6. Cancellations, Changes and Refunds

Cancellation, modification and refund conditions depend on the policies of each supplier and the specific conditions of the purchased service.

The client must submit any cancellation or modification request in writing to THE AGENCY.

Depending on the case, cancellations or changes may be subject to penalties, administrative fees, supplier charges, non-refundable amounts, exchange rate differences or other applicable costs.

Certain services may be non-refundable, non-changeable or subject to strict cancellation policies, especially during high season, holidays, special events, promotional rates, entrance tickets, airline tickets, train tickets, cruises or services with limited availability.

THE AGENCY will inform the client of the applicable conditions before or at the time of confirmation, whenever such information is available.

Refunds, when applicable, will be processed according to the terms of the corresponding supplier and may take time depending on banks, payment processors or third-party providers.

7. Passports, Visas and Health Requirements

All travellers must have a valid passport with a minimum validity of six months beyond the date of departure, unless the destination country establishes a different requirement.

Travellers are responsible for complying with passport, visa, immigration, customs, vaccination, health and entry requirements applicable to their nationality, destination, transit countries and travel dates.

THE AGENCY may provide general information regarding travel documentation requirements; however, such information is provided for guidance only and may change without prior notice.

Travellers must verify updated requirements with the corresponding embassies, consulates, immigration authorities, airlines or official government sources before travelling.

In the case of group travel, the group leader is responsible for ensuring that all members of the group possess the necessary travel, immigration and health documents prior to departure.

THE AGENCY shall not be liable if a traveller is denied boarding, entry into a country, access to a service, accommodation, transport or activity due to lack of documentation, expired documents, visa issues, health requirements or failure to comply with applicable regulations.

Any fines, penalties, additional costs, cancellations, losses or expenses arising from the traveller’s failure to comply with such requirements shall be borne exclusively by the traveller.

8. Travel Insurance

THE AGENCY strongly recommends that all travellers purchase adequate travel insurance covering medical expenses, accidents, trip cancellation, interruption, loss of luggage, delays, repatriation and other unforeseen events.

In some destinations or services, travel insurance may be mandatory.

If the client decides not to purchase travel insurance, they assume full responsibility for any costs, losses or damages that may arise during the trip.

9. Responsibilities of the Client

The client is responsible for:

  • Providing accurate, complete and updated personal and travel information.

  • Reviewing all quotations, confirmations, itineraries and travel documents.

  • Making payments within the established deadlines.

  • Arriving on time for transfers, tours, flights, trains, activities and scheduled services.

  • Complying with the rules, schedules and conditions of each supplier.

  • Respecting local laws, customs, communities, natural areas and cultural heritage.

  • Informing THE AGENCY in advance of any relevant medical condition, dietary restriction, mobility limitation or special requirement.

THE AGENCY shall not be responsible for consequences arising from incorrect information provided by the client or failure to comply with the obligations described above.

10. Third-Party Suppliers

Many travel services are provided directly by independent third-party suppliers, such as hotels, transport companies, local operators, guides, airlines, restaurants, museums, parks and experience providers.

THE AGENCY carefully selects and coordinates with suppliers; however, it does not directly control the operation, internal policies, infrastructure, personnel, schedules or decisions of such third parties.

Therefore, THE AGENCY shall not be liable for acts, omissions, delays, accidents, cancellations, schedule changes, overbooking, service failures, negligence or decisions attributable directly to third-party suppliers, except where applicable law establishes otherwise.

In the event of an incident involving a supplier, THE AGENCY will provide reasonable assistance to the client and seek an appropriate solution according to the circumstances and applicable supplier policies.

11. Changes Due to External Circumstances

THE AGENCY may modify, replace, reschedule or cancel services when necessary due to circumstances beyond its control, including but not limited to:

  • Weather conditions.

  • Natural disasters.

  • Social conflicts, strikes, protests or road blockades.

  • Government decisions or restrictions.

  • Health emergencies or pandemics.

  • Closure of airports, roads, ports, museums, parks or tourist attractions.

  • Supplier cancellations or operational issues.

  • Security risks.

  • Force majeure or unforeseeable events.

In such cases, THE AGENCY will make reasonable efforts to offer alternatives, reschedule services or coordinate solutions with suppliers. However, THE AGENCY shall not be responsible for additional expenses, losses or damages caused by events beyond its reasonable control.

12. Changes Requested by the Client During the Trip

Any change requested by the client during the trip will be subject to availability, supplier approval and additional costs.

THE AGENCY will assist the client whenever possible, but cannot guarantee that changes can be made once the trip has started.

Additional costs resulting from changes requested by the client shall be paid by the client before the modified service is provided, unless otherwise agreed.

13. Behaviour and Conduct

Travellers must behave respectfully toward other travellers, local communities, guides, suppliers and THE AGENCY’s representatives.

THE AGENCY or its suppliers may refuse, suspend or terminate services if a traveller behaves in a violent, offensive, unsafe, illegal, discriminatory or disruptive manner, or if their conduct puts themselves, others or the proper execution of the service at risk.

In such cases, no refund shall be granted, and any additional costs shall be borne by the traveller.

14. Minors

Minors must travel accompanied by their parents, legal guardians or duly authorized adults.

The client is responsible for ensuring that minors have all required authorizations, travel permits, identity documents, visas and any other documentation required by Peruvian or foreign authorities.

THE AGENCY shall not be responsible for denied boarding, denied entry or cancellation of services caused by missing or insufficient documentation for minors.

15. Website Use

Users agree to use this website lawfully and responsibly.

The following actions are prohibited:

  • Using the website for illegal or fraudulent purposes.

  • Attempting to access restricted areas without authorization.

  • Interfering with the operation, security or integrity of the website.

  • Copying, reproducing or using content without authorization.

  • Providing false, incomplete or misleading information.

THE AGENCY may restrict access to the website or its services if misuse is detected.

16. Intellectual Property

The texts, images, videos, designs, logos, trademarks, itineraries, travel proposals and other content used on THE AGENCY’s website, social media, commercial materials and communications are owned by ANDINA REISEN S.A.C. or used with authorization from suppliers, institutions, photographers, collaborators or third parties.

Unauthorized reproduction, distribution, modification, commercial use or publication of such content is prohibited without prior written authorization.

17. Personal Data Protection

The processing of personal data by THE AGENCY is governed by its Personal Data Protection Policy and by Peruvian Law No. 29733 – Personal Data Protection Law and its Regulations.

Personal data provided by clients may be used to manage quotations, reservations, payments, communications, travel services, legal obligations and other purposes related to the provision of services.

18. Communications

THE AGENCY may communicate with clients through email, telephone, WhatsApp, social media, forms, digital platforms or other physical or electronic channels.

The client authorizes THE AGENCY to use these channels for communications related to quotations, reservations, payments, travel coordination, service updates, emergencies, post-sale support and, when authorized, promotional information.

19. Complaints and Claims

In accordance with Peruvian consumer protection regulations, THE AGENCY shall make available to consumers a Complaints Book in physical or virtual format, as applicable.

Users may submit complaints or claims related to the services received through the channels made available by THE AGENCY.

The submission of a complaint or claim does not prevent the consumer from using other dispute resolution mechanisms or filing a complaint before the competent authority.

In Peru, suppliers must provide a Complaints Book to consumers in physical or virtual format when requested, including for online sales platforms.  

20. Limitation of Liability

THE AGENCY shall be responsible for fulfilling the services expressly agreed with the client, according to the confirmed quotation, itinerary or booking document.

However, THE AGENCY shall not be liable for damages, losses, delays, cancellations, additional expenses or inconveniences caused by:

  • Acts or omissions of the client.

  • Incorrect or incomplete information provided by the client.

  • Failure to comply with documentation, visa, immigration or health requirements.

  • Acts or omissions of third-party suppliers.

  • Force majeure or events beyond the reasonable control of THE AGENCY.

  • Decisions of authorities, airlines, hotels, transport companies or other independent providers.

  • Changes in weather, security, health, social or political conditions.

Nothing in these Terms and Conditions shall limit any rights that consumers may have under mandatory applicable law.

21. Applicable Law and Jurisdiction

These Terms and Conditions are governed by the laws of the Republic of Peru.

Any dispute, controversy or claim arising from the interpretation, execution or validity of these Terms and Conditions shall first be addressed through direct communication between the client and THE AGENCY.

If no agreement is reached, the parties may resort to the competent authorities or dispute resolution mechanisms established under Peruvian law.

22. Updates to these Terms and Conditions

THE AGENCY may update or modify these Terms and Conditions at any time to reflect changes in its services, legal obligations, commercial practices or internal procedures.

The updated version will be published on THE AGENCY’s website and will apply from the date of publication, unless otherwise stated.

Prices

All prices are in US dollars (USD) and are subject to change without prior notice. Rates may vary during special events, high seasons, or holidays. Prices are per person, based on a minimum of two people unless otherwise specified.

Reservation acceptance process/ way of working for each reservation

Reservation Status

When purchasing packages with pre-established departure dates directly on the website:

  1. You will receive an email with the purchased itinerary and the following guidelines to fully confirm the package.

  2. THE AGENCY will contact you via email to request all necessary passenger details, which include:

  • Full names

  • A scanned copy of the data page and/or a photo of the passport, or Peruvian DNI

  • Date of birth

  • Nationality

  • Dietary instructions

  • Special remarks

  • International arrival and departure flight details with PNR code (if available)

  • Domestic flight details with PNR code (if available)

If THE AGENCY needs to arrange flights as an additional service, this will also be communicated through the same channel.

After completing this process, you will receive a reservation confirmation.

When booking THE AGENCY’s services through email inquiries:

  1. The desired destinations and preferences will be collected from the passenger.

  2. We will proceed to advise and provide information about the best travel options available.

  3. Once the availability of the selected services is confirmed, we will issue a reservation status and send it to you. Please review this document carefully upon receipt and contact us immediately if any information appears incorrect or incomplete, as changes may not be possible later.

 4.To confirm the reservation, you must make the corresponding payment as instructed by the sales representative in charge of your booking. Additionally, you must submit all the required information as outlined in point A.2 of this document. The group leader must be at least 18 years old at the time of booking.

Passport Copy Requirement

In compliance with a government regulation related to international money laundering, the Peruvian State requires travel companies to obtain and keep a copy of the passport of all foreign travelers visiting Peru.

As a result, THE AGENCY must receive a copy of the passport information and photo page for each passenger before reconfirming travel services. These copies and the information contained within them will be handled with the utmost confidentiality and will not be used for any other purpose by THE AGENCY.

Not included

The passenger is responsible for obtaining passports, visas, travel insurance, payment of excess baggage, personal requests such as extra drinks, laundry service, communication (calls, emails, etc.), domestic and international airport departure taxes, tips, or other services and expenses not specified in the itinerary.

All inclusions are listed and detailed in the quotes, travel proposals. Therefore, anything not listed as included in the itinerary is not included.

SERVICES NOT USED

Some services may be interrupted or cancelled due to weather conditions, force majeure, acts of nature, strikes, etc., or other parties outside the control of the hotels, airlines and other suppliers, THE AGENCY or its partners. No refunds will be made as a result of these interruptions or cancellations beyond our control.

FLIGHT TICKETS

Airline ticket prices are subject to change without notice until final issuance. Flight schedules are subject to change by airlines until the day of flight. Additional restrictions, limitations, fines and/or specific conditions may be placed by airlines.

You must pay 100% to issue airline tickets. Fares are subject to availability at the time of purchase and base price (returns and changes allowed/not allowed, penalties apply/do not apply, etc.). Tickets are non-refundable and non-transferable in the event of cancellation.

Domestic and international flights are subject to overbooking, cancellations or rescheduling. In such cases, THE AGENCY will make every effort to assist customers in boarding their respective flights or make alternative arrangements. These actions are provided as a courtesy by THE AGENCY to its customers.

 

THE AGENCY will not be responsible for denied boarding, additional charges due to fare differences or expenses related to accommodation, meals and additional transfers provided by the airline in cases of flight cancellations or delays.

ADVENTURE ACTIVITIES

The performance of any of the adventure activities such as mountain biking, cycling, motorcycling, horseback riding, zip-lining, mountaineering, trekking, kayaking, rafting, stand up paddle, kitesurfing, windsurfing, sandboarding and paragliding, may require a letter signed by the traveler accepting the risks and implications of the same. If you do not agree to sign, you will not be able to participate in the service.

If you decide to include adventure or soft adventure activities in your itinerary, you recognize that such activities involve, by nature, a certain degree of risk, and you accept and assume the risks, implications and consequences derived from their practice.

You agree that THE AGENCY will not be responsible for any consequences associated with the practice of adventure and adventure activities. These acceptances also include family members or groups of travelers who participate in any soft adventure or adventure activity as part of your group.

We recommend having an insurance policy, which covers any medical expenses during the trip. In the event of an accident, we will not be liable for any medical expenses and/or costs of any kind. It is the traveler's responsibility to take out a medical insurance policy, which covers all types of eventualities.

DISCLAIMER CLAUSE

THE AGENCY shall not be liable for any injury, death, loss, delay, inconvenience, damage to personal property in connection with the provision of goods or services, whether as a result of, but not limited to, acts of God or force majeure, illness, government restrictions, acts of war, civil unrest, insurrection or revolt, animals, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or degradation of services, food poisoning, mechanical or other failure of aircraft or other means of transportation or the failure of any transportation mechanism to arrive or depart on time.

THE AGENCY shall not be liable for errors or omissions of any supplier (such as accommodation or transportation companies). We shall not be liable for lack of availability at hotels, lodges, shelters and/or camps requested by the client. In such cases, we will try to place the client in alternative accommodation of the same standard, without assuming any liability for the client's lack of satisfaction with the alternative accommodation. Our programs do not include travel insurance.

THE AGENCY reserves the right to withdraw, alter or modify any excursions, itineraries, specific programs or activities when deemed necessary or to safeguard the safety of passengers.

THE AGENCY reserves the right to modify the conditions, terms and procedures of reservation and program prices at any time without prior notice.

THE AGENCY reserves the right to take photographs or video recordings on any trip. Photographs or video recordings may be used for promotional and/or commercial purposes.
